MYCLOCKER PRIVACY POLICY

The Provider of MyClocker (PCubed (Pty) Ltd) (“we”, “us”, “our”) is committed to protecting your privacy and developing technology that gives you the most powerful and safe online experience. This Privacy Policy  applies to the MyClocker website and mobile applications (collectively the “Service”) and governs data collection and use, dissemination, disclosure and protection. By using the Service, you consent to the data practices described in this policy.

This  Privacy Policy applies to all personal data obtained, in any form, and which is in our possession or under our control for the purposes of and in connection with our contractual duties and provision of the Service.

This Privacy Policy is intended  to acknowledge the importance of and to provide a framework for the appropriate level of protection for consumer identification, collection, holding, using, disseminating, merging, collating, disclosing and protection of your personal information (“process” or “processing”). The policy represents our commitment to compliance with our  obligations under the Protection of Personal Information Act 4 of 2013 of South Africa (“POPIA”)

We reserve the right to effect amendments to the Privacy Policy, without notice, should it become necessary to do so.

Collection Of Your Personal Information

MyClocker collects personally identifiable information, such as your name, position, e-mail address, address or telephone number that you or your employer provide upon registration for the service.

MyClocker collects information such as the dates, times, images and descriptions relating to transactions that you log through the Service.

MyClocker collects data relating to the location at which transactions were logged through the  Service, as well as location data whilst you are logging travel through the Service, or whilst Clocked-in through the Service.

MyClocker collects information about your system hardware and software. This information can include your IP address, browser type, domain names and access times.

The information collected by MyClocker is used by us for the operation of the Service, to maintain quality of the service, and to provide general statistics regarding use of the Service.

If you directly disclose personally identifiable information or personally sensitive data through MyClocker, this information may be collected and used by other users.

We do not read any of your private online communications, or details of transactions submitted through the Service.

You have choices regarding our collection, use or disclosure of your personal information. You have the right to object to the processing of your personal information and withdraw your consent in a manner described in this policy.

In general, subject to the applicable exceptions permitted in the POPIA, before we collect personal information from you, we will notify you of the purposes for which your personal information may be collected, used and/or disclosed, as well as obtain your consent for the collection, use and/or disclosure of your personal information for the intended purposes. If you choose not to provide us with the personal information requested , we may not be able to fulfil our contractual duties towards you or facilitate your request or provide the service to you.

We may identify, collect, hold, disseminate, merge, disclose or use your personal information pursuant to an exception under the POPIA or other written law such as during the following situations:

  • To respond to an emergency that threatens our life, health and safety or of another individual; and
  • Necessary in the national interest, for any investigation or proceedings.

Use And Disclosure Of Your Personal Information

The Provider of MyClocker collects and uses your personal information to operate the Service and deliver the services you have requested. MyClocker may also contact you via surveys to conduct research about your opinion of current services or of potential new services that may be offered, and to inform you of Service updates or issues.

The Provider of MyClocker does not sell, or lease any of your personal information or customer lists to third parties.

The Provider of MyClocker does not use or disclose sensitive personal information, such as race, religion, or political affiliations.

The Provider of MyClocker will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on us or the site; (b) protect and defend our rights or property; and, (c) act under exigent circumstances to protect the personal safety of users of MyClocker, or the public.

The Provider of MyClocker may, from time to time, share your personal information with credit reporting bodies, credit providers and/or brokers and any other organisations which are involved in offering our services. We will only share your personal information for a lawful purpose. We ensure protection of your personal information, by only entering into agreements with third parties that have policies that comply with POPIA. Compliance with POPIA ensures the personal information we have disclosed is used only for the specific lawful purpose we have requested on your behalf. We may disclose your personal information to third parties if we are under a duty to disclose or share such information in order to comply with any legal obligation or to protect the rights, property or safety of the Provider of MyClocker, its clients and other related parties.

Withdrawal Of Consent

The consent that you provide for the collection, use and/or disclosure of your personal information will remain valid until such time it is being withdrawn by you. Should you wish to withdraw your consent, you may send your request through the contact details of our Information Protection Officer provided in this statement. Please understand that your withdrawal of consent for purposes necessary to MyClocker fulfilling our contractual duties towards you or facilitating your request or providing our services to you may carry consequences. We will review and inform you on the consequences of the withdrawal prior to processing your request.

Access And Correction Of Personal Information

If you wish to access, update or otherwise change or remove any information that you have provided to us, you may send your request through the contact details of our Information Protection Officer provided in this statement.

Accuracy Of Personal Information

The Provider of MyClocker will take reasonable steps to ensure that the personal information we collect about you is accurate, complete, not misleading and kept up-to-date, if necessary, for its intended use. Where possible, we will validate your personal information using general accepted practices and guidelines.

Security Of Your Personal Information

The Provider of MyClocker takes all reasonable precautions to secure your personal information from unauthorized access, use or disclosure. We secure the personally identifiable information you provide on computer servers in a controlled, secure environment, protected from unauthorized access, use or disclosure. When personal information (such as a credit card number) is transmitted to other Services, it is protected through the use of encryption, such as the Secure Socket Layer (SSL) protocol.

Retention Of Your Personal Information

The Provider of MyClocker will retain your personal information only for as long as the purposes for which such data is collected or used (as notified to you) continues, or where necessary, for our legal or business purposes. We will dispose of, delete or destroy documents containing your personal information in a secure manner as soon as it is reasonable to assume that the permitted purpose is no longer being served by their retention.

We will not retain any unsolicited personal information received by us. If received by email or through our Service, this unsolicited personal information will be immediately deleted . If received by telephone, it will not be recorded.

Transfer Of Information Between Us And A Third-Party Supplier

The information you provide may be transferred across foreign borders, as permitted in terms of Chapter 9 of POPI which authorizes the access seeker (known as the responsible party) permission to transfer the information across foreign borders under specific circumstances.

The Provider of MyClocker will occasionally update this Privacy Policy to reflect company and customer feedback. We encourages you to periodically review this Policy, and any updates to the Policy, to remain  informed of how we are protecting your personal information.

Terms And Conditions Of Use

This Privacy Policy must be read together with the MyClocker Terms and Conditions of Use, which is incorporated herein by reference.  The Terms and Conditions of Use and this Privacy Policy constitutes the entire agreement between you and the Provider of MyClocker and governs your use of the Service, superseding any prior agreements between you and the Provider of MyClocker.
